Since Joe Biden assumed the US presidency, the expectation is that immigration laws will be revised and less restrictive. While new measures are not implemented, will we know the current types of visas, the documents required?
The first step for anyone planning to apply for a job in the United States legally is to file a petition. This procedure must be done by the American company applying for the vacancy and receive approval from the United States Citizenship and Immigration Service (USCIS).
The US is one of the most sought after countries by foreigners looking for new opportunities. Therefore, work visas are separated into specific categories, which require different documents to prove education, authenticity and professional experience, for example.
6 types of immigration visas:
H1B visa:
It is valid for three years and can be extended for the same period. It is aimed at those who have university and postgraduate training, such as a master’s and doctorate, or extensive experience in the requested area.
The professional who wants to apply for this visa must inform himself on the website of the desired company if there is an interest in hiring Indians.
The offer of the vacancy goes through a process in the USA known as Labor Certification. This procedure is required to ensure that there are no US citizens available to fill the post, and as such, it may be offered to foreigners. For Parents Visa in Australia
H2B visa:
It is valid for 10 months and can be extended to three years. No higher level required. It is aimed at temporary or seasonal workers (peakload).
Hotels, theme parks, restaurant chains, resorts and cruises are some types of US companies that can hire foreigners through this visa.
The process for obtaining this permission is similar to H1B, but takes less time. It also requires a temporary employment certification application to Alien Labor Certification (ALC).
H2A visa:
It has the same characteristics as the H2B visa, but is specific to foreign workers in agricultural areas.
H3 visa:
It is aimed at interns, trainees and visitors to a special education program, such as training or vocational training.
Anyone holding this visa can enter the US and complete the training program for which they were admitted. But after completion, you must return to your home country.
One of the main visa requirements is that the applicant can only participate in training that is not available in their home country.
The visa is conditional upon the invitation of an individual or organization that manages one of the types of training programs allowed by the government, such as in the areas of Finance, Transport, Agriculture, Communications and Science.
H4 Visa:
It is the type of visa intended for family members of foreign applicants for employment, wife/husband and children under 21 years of age. They have the right to reside and study in the United States, however, they cannot perform any paid work, which is considered illegal.
O1 visa:
It lasts for three years. It is aimed at people who stand out in their field, such as receiving awards, honorable mentions, academic articles, journalistic articles, among others.
Those interested in this type of visa must demonstrate national or international recognition, through extensive documentation of their achievements.
It is the type of visa that the US immigration system has for a merit-based option. If the person “deserves it” due to his/her great CV, he/she gets the visa.
